Our in-house claims team work hard to ensure our clients receive the best outcome. You’ll never know how good your insurance broker is until you make a claim. Below shows a case where one of our clients was extremely appreciative of our work.
Our client had an incident where a sub-contractor was injured at a third party site. This was reported to the insurers at the time and involved a piece of machinery which was being used. The HSE took the machine away for testing after the incident. 2 years later the HSE sent a letter to our client informing them that the costs of testing the machine fell on them as they felt they had not properly instructed the sub-contractor on how to use the machinery as the main contractor.
Our client had a Management Liability Protection policy which covers these costs, however, Axa advised that as the matter had not been reported at the time (2 years prior) they would not entertain cover. Craig, our claims manager liaised with Rradar (Axa’s appointed solicitors) to challenge this, advising that the HSE invoice was a total surprise and they had been advised of the matter previously as a PL notification was made.
The challenge had the desired effect with Rradar confirming that Axa would indeed provide cover. The client were thankful for our assistance during this claim.
